Usage Policy (AUP)
Our
goal at MICROLINQ is to provide you with top quality service and the
opportunity to host your own website on the world wide web in the most
efficient and effective way possible. We continually upgrade our servers,
network, and support to help you achieve your goals in web hosting.
To keep our pricing down, we ask that you follow our acceptable use
policies. If you have any questions about these policies, please send

Web-site
Content. The content of your website will remain under your domain and
is not available to any other entity. You have the right to retain on
your site, any and all files that you seek to hold that do not violate
the following rules. Customers are prohibited from transmitting on or
through any of MICROLINQ services, any material (including software)
that is, in MICROLINQ's sole discretion: unlawful, obscene, threatening,
abusive, libelous, slanderous, encourages criminal mischief, gives rise
to civil liability, or otherwise violates any local, state, federal,
or international law and/or treatise. In short, MICROLINQ web hosting
services may only be used for lawful activities.
Pornography:
MICROLINQ has a zero stance policy on pornography that violates local,
state, federal, or international law. This includes, but is not limited
to, child pornography, bestiality, hard-core pornography, and others
not allowed by law. MICROLINQ does not seek to abridge any users constitutional
rights, but we uphold any and all laws applicable to the content of
sites hosted on our servers. MICROLINQ reserves the right to deny service
without cause for sites with adult content.
MICROLINQ
Solutions, Inc. shall not be held responsible for any wages earned or
lost for any reason on any web site hosted with MICROLINQ Solutions,
Inc.
MICROLINQ
does take an active role in monitoring all sites via the web for content
that does not comply with the preceding guidelines. MICROLINQ specifically
retains the right to make the final decision in any matter relating
to site content. If you wish to transfer or register your site with
MICROLINQ and you are concerned about content, please send your concerns
to manager@MICROLINQ.com.
Network
/ Systems. Shared web hosting was designed to give the maximum numbers
of users access to the internet at the lowest cost available. Our Network
usage is open to all MICROLINQ users. Your site is welcome on our network
as long as your site does not create a problem for the network. High
Network traffic or throughput is not a problem at MICROLINQ, but extreme
network traffic or extreme uploading and downloading can create problems.
Your maximum throughput allowed by your website is an estimate of your
usage. You are allowed to exceed your maximum usage without being shut
off. You will be billed for the additional throughput on your next billing
cycle. Please help MICROLINQ plan for the future and popularity of your
website. Excessive system processing demands (as determined by MICROLINQ),
that are levied on a server as a result of your site, may result in
immediate site shut down without previous notice. If you know in advance
due to advertising, publicity, or general interest that your throughput
will exceed 3 times the amount allowable by your plan, please contact
us at 972.867.4576 or at manager@MICROLINQ.com. This will ensure no
downtime and maximum availability of your website at all times. If you
expect to exceed the maximum amount of disk space by 3 times your plan
allotment, please contact us at manager@MICROLINQ.com. We can upgrade
you to another plan or make other arrangements to save you money and
to ensure your site is available at all times.
MICROLINQ
customers may not use our network to circumvent user authentication
or security of any host, network, or account. This includes, but is
not limited to, accessing data not intended for the customer, logging
into a server or account the customer is not expressly authorized to
access, password cracking, probing the security of other networks or
directly violating the security policy of another organization. Customers
are also not allowed to interfere or deny service to any user, host,
or network by flooding, mail bombing, or attempts to overload or crash
the host network. Furthermore, any service that is common to hackers
and brings negative attention to the MICROLINQ network is strictly prohibited.
This includes IRC, the re-selling of shell accounts and any other service
found to support adverse activity. Any violation of the network guidelines
set forth will result in deactivation of your web host for resolution.
Mass
Mailings. MICROLINQ has a zero stance policy on SPAM, Junk E-mail or
UCE. Spam, Junk-mail and UCE are defined as: the sending of the same,
or substantially similar, unsolicited electronic mail message, whether
commercial or not, to more than one recipient. A message is considered
unsolicited if it is posted in violation of a newsgroup charter or if
it is sent to a recipient who has not requested or invited the message.
UCE also includes e-mail with forged headers, compromised mail server
relays, and false contact information. This prohibition extends to the
sending of unsolicited mass mailings from another service, which in
any way implicates the use of the MICROLINQ servers. Violation of the
above terms will result in one or all of the following:
A warning
from MICROLINQ, via E-mail or phone.
Removal of DNS for the advertised / originating site.
Temporary shutdown of the server or a block on outgoing mail.
Permanent disconnection of service.
Repeat violation of the above terms will result in the following actions.
Immediate
disconnection of service with no re-activation.
$500 fee assessed to your account for violation.
Absolutely no refunds for any reason.
$10 per e-mail violation after notification.
If
your actions have caused MICROLINQ mail servers to be placed on blackhole
lists and other mail filtering software systems used by ISPs and Web
Hosting companies around the world, you will be assessed a $1000 charge
to your account and $150 per hour for administrative charges incurred
to remove and protect our mail servers and/or domain names. If you have
further questions about our mass mailing policy, please send them to
manager@MICROLINQ.com. If you want to report abuse by one of our users,
please send the e-mail to abuse@MICROLINQ.com.
Mailing
Lists: Our mass mailing rules also apply to mailing lists, list servs,
or mailing services you may contract with. Our policy is the following:
An acceptable mailing list will be focused at a target audience that
has voluntarily signed up for your e-mail information or that has made
their e-mail address available for distribution of information from
you. Your own list servers in which customers have signed up for in
the past, is a valid mailing list. If one of your members asks to be
removed, please remove them as soon as feasibly possible. Internally
created mailing lists are valid as long as your customers agree to receive
the e-mail. Purchased mailing lists are generally a violation of the
rules because you have not received authority from the recipient to
send them an e-mail. The final rule to all mailing lists is simple:
if your customers begin to send SPAM complaints to MICROLINQ about your
e-mail, you will be bound to the terms of mass mailings listed above.

Terms
and Conditions for Web Hosting Service with MICROLINQ
MICROLINQ
welcomes you and we ask that you read our service agreement below.
All
domain name registrations are due and payable upon submission as per
the ICANN rules. No refunds are available.
All
shared web-hosting accounts have a 30-day money back guarantee if you
are unable to access your web space. A prorated refund is not available
after the first 30 days of service on monthly or yearly accounts. Money
Back refunds are not applicable to former members or recurring yearly
accounts. Refunds are not applicable to special promotions.
Customers
agree they are responsible for any web site data throughput and/or disk
space overage charges they may incur from exceeding monthly throughput
/ storage limits. By using MICROLINQ systems, you agree that MICROLINQ
site statistical information is the sole determining factor in any overage
or throughput charges that may be levied.
This
type of information can be tracked easily through the customer Site
Administration Panels under "Disk Usage". This information,
as well as other statistics are available through the stats directory.
Information on how to access these files is also located within the
customer Site Administration Panels.
All
shared web-hosting accounts are designed by use for one individual or
corporate entity. You may not resell space located under your domain.
Sub-domains are an additional charge. Violation of this will result
in termination of your account without refund. If you seek to resell
space under your domain, you will need a developer account hosting package.
Sending
unsolicited e-mail, junk e-mail, and e-mail harassment from your domain
are violations of this agreement. It will result in termination of your
account with no refund.
eMail
spamming is not allowed. Any time spent to keep MICROLINQ's systems
from being blacklisted, as a direct result of spamming associated with
your account shall be billed at $150 per hour.
All
members are bound by the rules and regulations set forth by ARIN, Network
Solutions, FCC and ICANN. All applicable local, state, and federal laws
also bind all members.
Monthly
and yearly accounts will be automatically renewed at the end of their
term. If you do not wish to renew your account, please cancel your account
as stated below.
Cancellation
Policy. If you wish to cancel your services with MICROLINQ, please go
to email accounting@microlinq.com. Your cancellation will be noted immediately,
however, we do require 30 days notice to complete your current billing
cycle.
MICROLINQ
will typically communicate with the customer via email. MICROLINQ will
send email to the billing email address that the customer provides.
It is the reponsiblity of the customer to keep all account records current.
MICROLINQ
Solutions, Inc. has a zero stance policy on all pornography that violates
local, state, and federal laws of the United States. Please read our
Acceptable Use Policy located on our website. We reserve the right to
remove your domain without refund for violation of this policy. Management
discretion is the final authority.
MICROLINQ
Solutions, Inc. shall not be held responsible for any wages earned or
lost for any reason, regardless of fault, in association with any domain
name registered or web site hosted with MICROLINQ Solutions, Inc.
MICROLINQ
Solutions Inc. reserves the right to cancel any member for violating any
of these guidelines without any refund of service.
